| 2000年前后，国家图书馆开始进行数字资源建设，并且随着国家数字图书馆工程的立项与逐步实施，建设力度不断加大。其中，版权问题的解决举足轻重，影响全局。通过调研国内外一些同类项目的做法与经验并结合本馆的业务实践，国家图书馆认识到，只有对日趋丰富以至海量的自建资源、合作共建资源与外购资源进行有效的版权管理才能最大程度服务于各层次读者又避免侵权。因此，国家图书馆在严格遵守国家相关法律法规的前提下，积极探索解决版权问题的各种途径：保护自有版权，有偿、无偿征集版权，通过谈判或招投标购买版权，通过“送书下乡工程”、“文津图书奖评选”等公益性活动获取版权，充分利用著作权法的合理使用制度与法定许可制度等。在此基础上，根据各类资源的版权状态通过局域网或互联网最大程度为读者推送资源，并采取完善内部版权管理规范、加强版权知识培训与宣传力度、采用技术保护手段等措施予以保障。希冀在为本馆的数字业务保驾护航的同时，能为业界同类建设项目在版权处理方面提供一些参考。 |

| National Library of China(NLC) began digital resources construction around the year of 2000, and the intensity of construction has been continuously increasing along with the setting up and gradual implementation of National Digital Library Project. During these processes, solution of copyright issues really counts and is crucial to the overall situation. By investigating practices and experiences of similar projects both home and abroad as well as combining its own business, NLC realizes that only by effectively managing the copyrights of increasingly rich and massive information resources whether by self-constructing, cooperatively constructing and outsourcing can we serve various readers to the greatest extent while making libraries immune from copyright invasion. Therefore, under the premise of strictly abiding by copyright laws and regulations in China, NLC has been actively exploring multiple modes to resolve copyright issues: protecting copyright of our own; recruiting copyright whether with compensation measures or not, purchasing copyright through negotiation or bidding, requests of obtaining copyright through various public activities such as Sending Books to the Countryside and Wenjin Book Awards; taking full advantage of “fair use” and “legal license” in the current Copyright Law. Based on these measures, by pushing information resources to readers to the greatest extent through LAN or Internet according to the copyright status of various information resource and actively adopting protection measures such as perfecting internal copyright management rules, enhancing copyright training & advertising and technical protection, NLC hopes to benefit its own digital resource construction and service as well as provide some reference to the community when dealing with copyright issues. |
