| 文章基于数字时代的邻接权制度,讨论了数字图书馆邻接权人主体地位的确立依据,分析了<著作权法>和<信息网络传播权保护条例>中对著作权限制的合理使用和法定许可条款,认为现有法规条款还不能够满足数字图书馆发展的需要,还有必要确立数字图书馆应享有的相应信息网络传播邻接权,并论证了数字图书馆信息网络传播邻接权的权限范围. |

| This paper discusses the basis of dominant position of neighboring rights owner of digital libraries based on neighboring rights system in digital age,and analyses the fair use and statutory license terms in Copyright Law and Regulation on the Protection of the Right to Network Dissemination of Information.This paper comes to the conclusion that the terms can not meet the needs of development of digital library,and it's necessary to establish the neighboring rights of digital libraries,and demonstrates the scope of neighboring rights on information network transmission of digital libraries. |
