| 正确区分科技报告属于职务作品、法人作品还是委托作品，是确定科技报告著作权归属的前提。作品权属
性质不同，权利归属就不同。明确作品权属性质，有利于科技报告知识产权的保护、管理和运用，有利于国家科技报
告制度建设。以法律法规、政策，以及相关司法解释、专家学者观点等为依据，依次分析揭示科技报告的职务作品、
法人作品和委托作品的法律特征，并从多角度进行论证。分析结果显示，科技报告不是法人作品和委托作品，科技报
告属于职务作品，其中部分属于合作作品。 |

| To correctly distinguish a scientific and technical report that whether it belongs to duty work, legal
person work or commissioned work is the precondition of determining copyright ownership of scientific
and technical reports. Since the ownership of works are different, the right of ownership are also different.
Clarifying the works of ownership will be helpful for the protection, management and application of intellectual
property rights, and the construction of national science and technology report system. Based on the laws and
regulations, policies, the relevant judicial interpretations and the views of experts and scholars and so on, this
paper analyzes and reveals the legal characteristics of duty work, legal person work and commissioned work
of scientific and technical report in turn, and then demonstrates them from different aspects. It comes to the
conclusion that scientific and technical reports are not legal person work or commissioned work, it’s the duty
work, and part of them belong to the joint work. |
