| The United States is actively advancing its intellectual property strategy to protect domestic
industries and extend the extraterritorial application of its laws globally. Key measures include the U.S. Section
337 investigations, Section 301 investigations, and the 2022 Protecting American Intellectual Property Act,
which targets foreign entities or individuals involved in the theft of the U.S. trade secrets. This legislation not
only safeguards the U.S. innovation and competitiveness but also significantly impacts global trade rules and
IP protection standards. As Chinese companies increasingly engage in global markets, they need to pay close
attention to these changes to avoid potential legal risks. Against the backdrop of the U.S.’s active protection of
domestic industries and the expansion of the extraterritorial application of its laws, China should strengthen
its own IP legal framework, encourage domestic companies to invest in research and innovation, and actively
participate in the formulation of international IP rules to enhance its global influence. Additionally, Chinese
companies should establish effective risk management systems to safeguard their legitimate rights and interests. |
